Implementation regulation of PRC - EU Cooperation
under
the Framework of National Basic Research Program
( DRAFT )

According to the "Agreement for Scientific and Technological Cooperation between the Government of the People's Republic of China and the European Community", the European Community opens all the activities of research, technological development and demonstration in the First Activity of the Framework Program under Article 130g of the Treaty establishing the European Community for the Chinese participation, and the Ministry of Science and Technology of the People's Republic of China opens the National Basic Research Program for the European participation. This implementation regulation is established to encourage and promote the cooperation between the Chinese and the European scientists under the framework of National Basic Research Program.

Article 1 Principles

Cooperative activities under the framework of National Basic Research Program shall be conducted on the basis of the following principles:
(a) efficient cooperation based on mutual benefit and interest;
(b) be subject to the Agreement for Scientific and Technological Cooperation between the Government of the People's Republic of China and the European Community.

Article 2 Forms of cooperative activities

The cooperative activities under the frame of National Basic Research Program include following aspects:
(a) joint proposals to participate the call for proposals of the Program and other joint research under the frame of the Program;
(b) visit and exchange of scientists and technical experts;
(c) joint organization of scientific seminars, symposia and workshops related to the content of research projects and the projects administration of the Program;
(d) exchanges and sharing of the equipment and materials;
(e) exchanges and sharing of information on practices, laws, regulations and Program;
(f) other joint activities.

Article 3 Procedures

1. submit joint proposals to participate the call for proposals and other joint research project under the frame of the Program:
(a) The Ministry of Science and Technology will formulate and publish the major domains opened for call for proposals (guidance of projects) either regularly or irregularly. The Delegation of the European Commission in Beijing will get the guidance and relevant information in 20 days after the publication of the guidance;
(b) Each proposal should have European scientists from at least two research entities in at least two Member States and Chinese scientists from at least two independent research entities. The proposal must be concluded on the basis of the guidance for proposes.
(c) The proposal must be signed by all the partners and submitted to the Ministry of Science and Technology by one of the Chinese partner before the deadline. The proposal must be submitted in Chinese and English versions.
(d) All proposals needed to pass an expert evaluation. The evaluation criteria will be the same towards the joint proposals and the proposals with only Chinese participation. The Department of Basic Research of MOST will inform the participants if a project defence is necessary.
(e) The proposals passed the evaluation will be submitted to the council of program for further examination and discussion. The council of program will submit to the MOST a list of proposals for final approval. The approved proposals will be implemented according to its work program. The Chinese partners need to sign a project contact with MOST. The Department of Basic Research of the MOST will inform all proposes the results of evaluation.
(f) The proposals must indicate: the research domain, the names of Chinese and European proposes, institutions, communicated numbers, the Chinese and European coordinators. The content of proposal should include: background, actual situation and tendency of the research, description and objectives of the work, general research plan, divide of work among participants, actual work condition and facilities, research team, budget, etc.
(g) The cooperation contract between the Chinese partners and the European partners must be submitted to the chief scientist of the project, the Department of Basic Research and the Department of International Cooperation of MOST. The progress report of the cooperation also needed to be handled in time.

2. Points (b), (c), (d), (e), (f) of article 2 in this regulation are fully encouraged. Point (a) in this article would be better to be implemented together with other points in this article.
3. In order to facilitate the cooperation between the Chinese and European scientists, the Department of Basic Research and the Department of International Cooperation of MOST will provide the list of projects and chief scientists of projects.

Article 4 Resource

(a) Cooperative activities shall be subject to the availability of appropriated fund and personnel. The costs incurred by the participants to cooperative activities will not lead to any transfer of funds from one side to the other.
(b) Each side will provide its own research fund for the cooperative project.

Article 5 Scope of Validity

(a) Cooperative activities shall be subject to the "Agreement for Scientific and Technological Cooperation between the Government of the People's Republic of China and the European Community" and to the applicable regulations and procedures. The validity of this regulation will be ended when the Agreement is terminated.
(b) Any problem occurred in the implementation of this regulation will be settled between the Department of Basic Research and the Department of International Cooperation of MOST and the relevant scientists.
(c) The Chinese institutions and scientists who participate the cooperation under this regulation shall be subject to a series of relevant regulations.
(d) The Ministry of Science and Technology holds the right of the explanation of this regulation.
